1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the website operated by My Mobility Center, LLC (“My Mobility Center,” “we,” “us,” or “our”) at mymobilitycenter.com and related digital properties (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.

Important Arbitration Notice

Section 14 of these Terms contains a binding arbitration agreement and class action waiver that requires individual arbitration of disputes instead of jury trials or class actions. You have the right to opt out of arbitration within 30 days of first accepting these Terms as described in Section 14.8. Please read Section 14 carefully.

2. Eligibility

You must be at least 18 years old to use the Site or submit information through any form on the Site. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian. By using the Site, you represent that you meet these eligibility requirements.

3. License to Use the Site

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use, or for legitimate business purposes related to evaluating our services. This license does not include any right to resell, redistribute, or commercially exploit the Site or its content.

4. Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
  • Interfere with or disrupt the operation of the Site or the servers or networks connected to the Site.
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or any computer systems or networks connected to the Site.
  • Use any robot, spider, crawler, scraper, or other automated means to access the Site or extract data from the Site.
  • Submit false, misleading, or fraudulent information through any form on the Site.
  • Upload viruses, malware, or any other malicious code to the Site.
  • Harass, threaten, defame, or otherwise violate the legal rights of any other person.
  • Use the Site to send unsolicited commercial communications.
  • Reverse engineer, decompile, or attempt to extract source code from the Site.
  • Use the Site in any manner that could damage, disable, overburden, or impair the Site.

5. Intellectual Property Rights

All content on the Site, including text, graphics, logos, images, photographs, audio, video, software, and the selection and arrangement of such content, is owned by My Mobility Center, our affiliates, our licensors, or our content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

“My Mobility Center” and our logos are trademarks of My Mobility Center, LLC. “Custom Mobility” and related marks are trademarks of our affiliated entity. Other trademarks, service marks, and logos used on the Site are the property of their respective owners, including the manufacturers whose equipment we sell and service.

Except as expressly permitted by these Terms, you may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any of the content on the Site without our prior written permission.

6. User-Submitted Information

When you submit information through any form on the Site (including consultation requests, careers inquiries, contact forms, and similar), you grant My Mobility Center a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable license to use, store, reproduce, modify, and process that information for the purposes described in our Privacy Policy.

You represent and warrant that any information you submit is accurate, that you have the right to submit it, and that your submission does not violate the rights of any third party.

7. Product and Service Information

The Site provides general information about products and services we offer. Specific equipment specifications, pricing, availability, warranty terms, and service details vary by product, location, and individual circumstances. Information on the Site is for general reference. Any sale of products or services is governed by separate written agreements, quotes, or purchase orders that you receive from us. In the event of any conflict between information on the Site and a written agreement signed by both parties, the written agreement controls.

We make no representation that products described on the Site are available in all locations. Manufacturer brand names appear on the Site to identify products we sell and service, and do not imply endorsement of My Mobility Center by those manufacturers unless explicitly stated.

8. Third-Party Links and Content

The Site may contain links to third-party websites, manufacturer websites, partner resources, and other external content. We provide these links for convenience. We do not control, endorse, or assume responsibility for any third-party content, products, services, or practices. Your use of third-party websites is at your own risk and subject to the terms and policies of those websites.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT, INFORMATION, MATERIALS, AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND COMPLETENESS.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.

This disclaimer applies only to information on the Site. Warranties on products we sell or services we perform are governed by separate written agreements and manufacturer warranties.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MY MOBILITY CENTER, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless My Mobility Center, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your use of the Site, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including but not limited to violation of these Terms. The provisions of these Terms that by their nature should survive termination, including intellectual property rights, disclaimers, limitations of liability, indemnification, arbitration, and governing law, will survive.

13. Governing Law and Venue

These Terms and your use of the Site are governed by the laws of the State of Georgia, without regard to its conflict of laws principles. Subject to the arbitration agreement in Section 14, any legal action arising out of or related to these Terms or the Site that is not subject to arbitration will be brought exclusively in the state or federal courts located in Clarke County, Georgia, and you consent to the personal jurisdiction and venue of those courts.

14. Binding Arbitration and Class Action Waiver

Please read this Section 14 carefully. It limits your legal rights and affects how disputes between you and My Mobility Center will be resolved.

14.1 Agreement to Arbitrate

You and My Mobility Center, LLC (the “Parties”) agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any service we provide (each, a “Dispute”) that cannot be resolved through informal negotiation will be resolved exclusively through final and binding individual arbitration, except as set forth in Section 14.7 below. This agreement to arbitrate is governed by the Federal Arbitration Act, 9 U.S.C. ยงยง 1 et seq.

14.2 Pre-Arbitration Notice and Informal Resolution

Before initiating arbitration, the Party with the claim must send the other Party a written Notice of Dispute describing the nature and basis of the claim and the relief sought. Notice to My Mobility Center must be sent to: My Mobility Center, LLC, Attention: Legal Department, 315 Whitehead Road, Athens, GA 30606. Notice to you will be sent to the most recent contact information on file. The Parties will attempt in good faith to resolve the Dispute through negotiation for thirty (30) days after the Notice is received. If the Dispute is not resolved within that period, either Party may initiate arbitration.

14.3 Arbitration Rules and Forum

Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules in effect at the time the arbitration is commenced, except as modified by this Agreement. The AAA Rules are available at adr.org or by calling the AAA at 1-800-778-7879. The arbitration will be conducted by a single neutral arbitrator. The arbitration will take place in Athens, Georgia, or at the option of the consumer Party, by telephone, video conference, or based on written submissions only.

14.4 Class Action Waiver

THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THEIR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION OR PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING. If a court of competent jurisdiction decides that applicable law precludes enforcement of any of this paragraph’s limitations as to a particular claim for relief, then that claim (and only that claim) must be severed from the arbitration and may be brought in court subject to Section 13.

14.5 Mass Arbitration Coordination

If twenty-five (25) or more substantially similar Notices of Dispute or arbitration demands are filed against My Mobility Center within a sixty (60) day period by the same or coordinated counsel (a “Mass Filing”), the Parties agree that the AAA Consumer Mass Arbitration Supplementary Rules will apply. The Parties further agree to work with AAA to select a small number of representative claims to proceed to arbitration first, with the remaining claims stayed pending resolution. After resolution of the representative claims, the Parties will meet and confer in good faith regarding the resolution of the remaining claims.

14.6 Arbitration Costs and Fees

My Mobility Center will pay all filing, administrative, and arbitrator fees if you initiate arbitration of a Dispute valued at $10,000 or less and your claim is brought in good faith. For Disputes valued above $10,000, the AAA Rules govern the allocation of fees. Each Party will bear its own attorneys’ fees and costs, except as may be awarded by the arbitrator under applicable law or as required by AAA Rules.

14.7 Exceptions to Arbitration

The following are not subject to the arbitration agreement in this Section 14:

  • Claims qualifying for resolution in small claims court, which may be brought in small claims court at the option of either Party.
  • Claims for injunctive or other equitable relief to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, which may be brought in a court of competent jurisdiction.
  • Claims of sexual assault or sexual harassment, which are excluded from this arbitration agreement consistent with the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021 (Pub. L. 117-90).

14.8 Thirty-Day Opt-Out Right

You have the right to opt out of this arbitration agreement. To opt out, send written notice to: My Mobility Center, LLC, Attention: Legal Department, 315 Whitehead Road, Athens, GA 30606, or email info@mymobilitycenter.com with the subject line “Arbitration Opt-Out,” within thirty (30) days of first accepting these Terms. Your opt-out notice must include your full name, mailing address, email address, and a clear statement that you wish to opt out of this arbitration agreement. Opting out of arbitration will not affect any other provision of these Terms. Failure to opt out within thirty days constitutes your acceptance of this arbitration agreement.

14.9 Arbitrator’s Authority

The arbitrator has exclusive authority to resolve any Dispute relating to the interpretation, applicability, enforceability, or formation of these Terms or this arbitration agreement, including any claim that all or any part of these Terms or this arbitration agreement is void or voidable. The arbitrator may award any relief that a court could award, including injunctive and declaratory relief, but only in favor of the individual Party seeking relief and only to the extent necessary to provide relief warranted by that Party’s individual claim.

14.10 Limitations Period

Any claim or cause of action arising out of or related to these Terms or the Site must be filed within one (1) year after such claim or cause of action arose, regardless of any statute or law to the contrary. Any claim not filed within this period is permanently barred.

14.11 Survival

This arbitration agreement survives termination of these Terms and your use of the Site.

14.12 Severability of Arbitration Provisions

If any portion of this arbitration agreement (other than the Class Action Waiver in Section 14.4) is found to be invalid or unenforceable, that portion will be severed and the remainder of the arbitration agreement will continue in full force. If the Class Action Waiver is found to be invalid or unenforceable as to any particular claim, then this entire arbitration agreement will be unenforceable as to that claim only, and the claim will be resolved in court subject to Section 13.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced on the Site, constitute the entire agreement between you and My Mobility Center regarding the Site and supersede all prior agreements and understandings.

17. Modifications

We may modify these Terms at any time by posting the updated Terms on the Site. The “Effective Date” and “Last Updated” date at the top of these Terms will reflect when they were last revised. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms, except that material changes to the arbitration agreement in Section 14 will only apply to claims arising after the change becomes effective, and you will be given an opportunity to opt out of the modified arbitration provisions in accordance with Section 14.8.
